Important Notice

Please read these Terms and Conditions ("Terms") carefully before accessing or using the KlosetAI mobile application, website, social features, virtual try-on services, wardrobe management tools, artificial intelligence features, product discovery tools, and any related services (collectively, the "Service").

By creating an account, accessing, downloading, using, or otherwise interacting with the Service, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. These Terms form a legally binding agreement between you and KlosetAI ("KlosetAI," "we," "our," or "us").

Section 1. Definitions

For purposes of these Terms:

"Account" means a registered user account created to access the Service.

"Affiliate Product" means any product, service, or commercial offering displayed through the Service for which KlosetAI may receive compensation, commissions, referral fees, advertising revenue, or other consideration.

"AI Content" means any content, recommendations, classifications, outfit suggestions, generated images, try-on outputs, metadata, product matches, style analyses, wardrobe categorisations, or other outputs generated or assisted by artificial intelligence systems.

"Body Profile Image" means a photograph, image, scan, or other visual representation submitted by a user for virtual try-on, body-shape analysis, size estimation, styling recommendations, or related personalisation features.

"Content" means any text, image, photograph, video, link, URL, comment, profile information, generated image, outfit, product information, or other material submitted, uploaded, imported, displayed, stored, shared, or generated through the Service.

"Generated Content" means AI-generated images, virtual try-on outputs, outfit renderings, style recommendations, wardrobe suggestions, and other content produced by or through the Service.

"Imported Content" means content submitted to the Service through links, URLs, screenshots, videos, images, or references originating from third-party platforms, including social media platforms.

"Social Feed" means any public, semi-public, or community-facing area of the Service where users may publish, share, discover, browse, or interact with Content.

"User Content" means any Content submitted, uploaded, imported, linked, generated, shared, posted, transmitted, or otherwise provided by a user.

"Virtual Try-On" means any feature that uses AI, image processing, machine learning, computer vision, generative models, or similar technologies to create simulated visual representations of clothing, accessories, outfits, or fashion items on a user's likeness or body profile.

Section 2. Eligibility

2.1 Minimum Age

You must be at least sixteen (16) years old to create an Account or use the Service. By using the Service, you represent and warrant that you are at least sixteen (16) years old, have the legal capacity to enter into a binding agreement, are not prohibited from using the Service under applicable laws, and that all information provided by you is accurate and complete.

2.2 Regional Restrictions

The Service may not be available in all countries, regions, or jurisdictions. KlosetAI reserves the right to restrict, suspend, or terminate access to the Service in any jurisdiction at any time.

2.3 Business Users

If you use the Service on behalf of a company, organisation, or other legal entity, you represent that you have authority to bind that entity to these Terms.

Section 3. Account Registration

3.1 Account Creation

To access certain features of the Service, you may be required to create an Account. You agree to provide accurate, current, and complete information during registration and to keep such information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials, all activities occurring under your Account, restricting access to your devices, and promptly notifying KlosetAI of any unauthorised use of your Account. KlosetAI shall not be liable for losses resulting from unauthorised use of your Account.

3.3 Account Ownership

Accounts are personal to the registered user and may not be sold, transferred, rented, licensed, shared, or otherwise assigned without our written consent.

Section 4. Description of the Service

KlosetAI provides fashion-related technologies and services that may include:

• (a) AI-powered outfit detection
• (b) clothing item identification
• (c) digital wardrobe management
• (d) virtual try-on technology
• (e) outfit generation and styling recommendations
• (f) product matching and product discovery
• (g) affiliate commerce integrations
• (h) social sharing functionality
• (i) public and private user profiles
• (j) imported content analysis
• (k) image and video analysis
• (l) outfit extraction from screenshots and URLs
• (m) AI-generated fashion recommendations and imagery
• (n) fashion inspiration and community features

KlosetAI may modify, suspend, remove, discontinue, or introduce features at any time without liability.

Section 5. Imported Content and Third-Party Links

5.1 Content Imported from Third-Party Platforms

The Service may allow users to submit Instagram links, TikTok links, Pinterest links, website URLs, screenshots, images, videos, and other externally sourced content. Users are solely responsible for ensuring they have all necessary rights, permissions, authorisations, and legal bases required to submit such content for processing through the Service.

5.2 No Ownership of Third-Party Content

KlosetAI does not claim ownership of third-party content imported from external services. Any intellectual property rights associated with imported content remain with their respective owners.

5.3 User Responsibility

You represent and warrant that any content you upload, submit, import, link, reference, or otherwise provide does not infringe any copyright, trademark, publicity right, privacy right, or other intellectual property right; does not violate any law, regulation, or third-party agreement; and may lawfully be processed through the Service.

5.4 Third-Party Platforms

KlosetAI is not affiliated with, endorsed by, sponsored by, or officially associated with any social media platform, retailer, marketplace, content creator, influencer, or third-party service unless explicitly stated otherwise. Any trademarks, logos, brand names, product names, and platform names remain the property of their respective owners.

Section 6. User Content

6.1 Ownership of User Content

Except as expressly stated in these Terms, you retain ownership of the User Content that you submit, upload, import, generate, post, share, or otherwise provide through the Service. Nothing in these Terms transfers ownership of your User Content to KlosetAI.

6.2 Licence Granted to KlosetAI

By uploading, importing, generating, posting, linking, sharing, storing, or otherwise providing User Content through the Service, you grant KlosetAI a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, process, modify, adapt, analyse, display, distribute, transmit, and use such User Content to operate, maintain, improve, and provide the Service; to perform outfit detection, clothing identification, styling analysis, wardrobe generation, and product matching; to generate AI-powered recommendations and outputs; to create and display Virtual Try-On results; to provide social features; to detect fraud, abuse, and security incidents; and to train, evaluate, improve, monitor, and optimise internal systems to the extent permitted by applicable law and our Privacy Policy. This licence continues only for as long as reasonably necessary to operate the Service and fulfil the purposes described in these Terms and our Privacy Policy.

6.3 Public Content Licence

If you publish Content to the Social Feed or otherwise make Content publicly visible, you grant KlosetAI the right to display such Content publicly, feature it within the Service, and promote, distribute, recommend, and surface it to other users in connection with community, discovery, and engagement features.

6.4 User Representations

You represent and warrant that you own or control the rights necessary to provide the User Content, and that your User Content does not violate applicable laws, infringe third-party rights, or violate these Terms.

Section 7. Body Profile Images and Virtual Try-On Features

7.1 Body Profile Images

Certain features may require you to upload photographs of yourself, including full-body images, portrait photographs, or other visual references. These images may be used to personalise outfit recommendations, generate Virtual Try-On results, improve clothing visualisation, estimate body proportions, and provide styling recommendations.

7.2 Storage of Body Profile Images

Unlike certain imported content that may only be processed temporarily, Body Profile Images may be stored by KlosetAI to support ongoing personalisation and Virtual Try-On functionality. Users may delete Body Profile Images where such functionality is provided through the Service.

7.3 Generated Try-On Images

Virtual Try-On outputs generated through the Service may be stored within a user's account until deleted by the user or removed in accordance with our data retention policies. Users may download, share, publish, or otherwise use Generated Content subject to these Terms.

7.4 User Responsibility

You are solely responsible for obtaining permission from any person appearing in uploaded images, ensuring uploaded images do not violate privacy rights, and complying with applicable laws relating to image use.

7.5 No Accuracy Guarantee

Virtual Try-On results are generated using artificial intelligence and image processing technologies. Generated images may differ from real-world appearance, inaccurately represent fit or sizing, contain visual artefacts, misrepresent colours or textures, or differ from actual products. Virtual Try-On outputs are for visualisation and entertainment purposes and should not be relied upon as guarantees of actual appearance, fit, sizing, or product performance.

Section 8. AI Features and AI-Generated Content

8.1 Nature of AI Systems

The Service uses artificial intelligence, machine learning, computer vision, generative models, and automated decision-making systems to provide various features. These technologies may generate errors, inaccuracies, omissions, or unexpected outputs.

8.2 No Guarantee of Accuracy

KlosetAI does not guarantee that outfit detections, clothing classifications, style recommendations, generated images, wardrobe categorisations, product recommendations, or AI outputs are free from mistakes.

8.3 Product Identification

The Service may identify clothing items appearing in uploaded images, videos, screenshots, or imported content. Such identifications are generated through automated systems and may be inaccurate. An item identified by the Service may differ from the actual item appearing in the source content.

8.4 AI Recommendations

Recommendations generated by the Service are informational and stylistic in nature. Users remain solely responsible for decisions made based on AI-generated recommendations.

8.5 AI Availability

KlosetAI may change, update, replace, suspend, or discontinue AI systems at any time without notice.

Section 9. Social Features and Public Content

9.1 Public Posting

The Service may allow users to publish Generated Content, outfits, try-ons, wardrobe creations, and related materials to a Social Feed. Unless otherwise indicated, content shared to public areas of the Service may be visible to other users.

9.2 Visibility of Generated Content

Users acknowledge that Generated Content shared through social features may be viewed by other users, interacted with by other users, shared through platform functionality, and surfaced in recommendations and discovery systems.

9.3 Privacy Settings

Where available, users may modify privacy settings controlling the visibility of certain content. KlosetAI does not guarantee that privacy settings will prevent all access, indexing, sharing, screenshots, copying, or redistribution by other users.

9.4 Community Standards

Users may not post, upload, generate, publish, share, transmit, or otherwise distribute content that is unlawful, infringes intellectual property rights, is defamatory, is abusive or harassing, promotes hate or violence, contains sexually explicit material, contains non-consensual imagery, impersonates another person, is misleading or fraudulent, or violates privacy rights.

9.5 Enforcement

KlosetAI may investigate and take action regarding violations of these Terms, including content removal, account suspension, account termination, feature restrictions, and reporting to authorities where required.

Section 10. Content Moderation

KlosetAI reserves the right, but not the obligation, to monitor, review, moderate, remove, restrict, edit, disable, or refuse any Content. Content may be reviewed through automated systems designed to identify policy violations, spam, abuse, harmful content, or security threats. KlosetAI may remove Content without prior notice if we reasonably believe such Content violates these Terms, applicable law, user safety requirements, intellectual property rights, or platform policies. KlosetAI is not obligated to host, display, distribute, or maintain any Content submitted through the Service.

Section 11. Copyright Complaints

KlosetAI respects intellectual property rights and expects users to do the same. If you believe Content available through the Service infringes your copyright or other intellectual property rights, you may submit a written notice containing identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement of good-faith belief, a statement made under penalty of perjury that the information provided is accurate, and your physical or electronic signature. KlosetAI reserves the right to suspend or terminate accounts of repeat infringers.

Section 12. Product Matching, Shopping Features, and Affiliate Disclosures

12.1 Product Discovery Features

The Service may provide product identification, product matching, product recommendations, shopping suggestions, product search results, retailer listings, and similar-product discovery features powered by artificial intelligence systems, retailer feeds, affiliate networks, commercial databases, third-party product providers, publicly available online information, and automated matching technologies.

12.2 Product Matching Limitations

Users acknowledge that product matching is inherently imperfect. Products displayed by the Service may be exact matches, approximate matches, visually similar alternatives, substitute products, or stylistically comparable items selected through automated recommendation systems. KlosetAI does not guarantee that any displayed product is the exact item appearing in uploaded images, videos, screenshots, social media content, or imported materials.

12.3 Product Availability

KlosetAI does not guarantee product availability, inventory levels, retailer availability, shipping availability, pricing accuracy, discount availability, or merchant performance.

12.4 Affiliate Relationships

Some products, services, merchants, retailers, marketplaces, or commercial partners presented through the Service may participate in affiliate, referral, sponsorship, advertising, or commercial programs. KlosetAI may receive compensation when users click affiliate links, visit partner websites, purchase products, or engage with sponsored content.

12.5 No Seller Relationship

KlosetAI is not the seller, manufacturer, distributor, importer, retailer, warranty provider, or fulfilment provider of products displayed through the Service. All purchases are conducted between users and third-party merchants. Any disputes regarding purchased products must be resolved directly with the applicable merchant.

Section 13. Subscriptions, Premium Features, and Billing

13.1 Free and Paid Services

KlosetAI may offer both free and paid versions of the Service, including premium subscriptions, recurring memberships, free trials, promotional offers, in-app purchases, and premium feature access.

13.2 Subscription Plans

Subscription plans may include features such as unlimited outfit processing, additional AI generations, enhanced try-on capabilities, expanded wardrobe storage, priority processing, premium styling tools, and exclusive functionality. Features may change over time.

13.3 Automatic Renewal

Unless cancelled before renewal, subscriptions automatically renew for successive periods equal to the original subscription term. You authorise recurring charges until cancellation.

13.4 Cancellation

Users may cancel subscriptions through the platform from which the subscription was purchased. Cancellation becomes effective at the end of the current billing period unless otherwise required by law.

13.5 Free Trials

KlosetAI may offer free trials. At the conclusion of a free trial, applicable subscription charges may begin automatically unless cancelled before trial expiration.

13.6 Pricing Changes

KlosetAI reserves the right to modify pricing, subscription plans, premium features, and billing structures at any time. Where required by law, advance notice will be provided.

13.7 Refunds

Except where required by applicable law or platform policies, payments are non-refundable. App store purchases may be governed by the refund policies of the applicable platform.

Section 14. Advertising and Rewarded Content

The Service may contain advertisements, sponsored content, affiliate placements, promotional materials, and marketing communications. Certain functionality may be unlocked through rewarded actions such as viewing advertisements. KlosetAI reserves the right to modify, remove, or limit rewarded access programmes. KlosetAI may receive compensation for displaying sponsored content, advertisements, recommendations, or promotions.

Section 15. Prohibited Activities

Users agree not to:

• (a) violate any applicable law
• (b) infringe intellectual property rights
• (c) upload content they do not have rights to use
• (d) impersonate another person or entity
• (e) submit false information
• (f) harass, threaten, intimidate, or abuse others
• (g) exploit minors
• (h) distribute malware, viruses, spyware, or malicious code
• (i) interfere with the operation of the Service
• (j) attempt unauthorised access to systems or accounts
• (k) reverse engineer, decompile, or disassemble the Service except where legally permitted
• (l) scrape, harvest, copy, or extract data at scale
• (m) use bots or automated systems without authorisation
• (n) circumvent security measures
• (o) manipulate recommendation systems or create fake engagement
• (p) abuse free trials, promotions, or reward systems
• (q) use the Service for illegal commercial activities

Section 16. Enforcement

KlosetAI may investigate suspected violations of these Terms and users agree to reasonably cooperate with such investigations. KlosetAI may take any action it reasonably considers necessary, including warnings, content removal, feature restrictions, account suspension, account termination, legal action, and referral to law enforcement authorities. Where necessary to protect users, systems, intellectual property, or public safety, KlosetAI may immediately suspend access without prior notice.

Section 17. Account Suspension and Termination

17.1 Suspension by KlosetAI

KlosetAI may suspend or restrict accounts for any reason including suspected violations of these Terms, applicable laws, intellectual property rights, security requirements, or community standards.

17.2 Termination by KlosetAI

KlosetAI may terminate accounts at its discretion where continued access presents legal, operational, reputational, security, or business risks.

17.3 User Termination

Users may stop using the Service at any time and may request account deletion where such functionality is available.

17.4 Survival

The sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution survive termination.

Section 18. Intellectual Property Rights

18.1 Ownership of the Service

The Service, including all software, source code, algorithms, databases, interfaces, designs, trademarks, logos, branding, graphics, visual elements, text, compilations, technology, AI systems, machine learning systems, recommendation systems, and related intellectual property, is owned by KlosetAI or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, no rights are granted to users.

18.2 KlosetAI Trademarks

"KlosetAI" and all associated names, logos, product names, service names, designs, and slogans are the property of KlosetAI or its affiliates. Users may not use such marks without prior written permission.

18.3 Feedback

If you provide suggestions, ideas, recommendations, feature requests, improvements, or feedback regarding the Service, you grant KlosetAI a perpetual, irrevocable, worldwide, royalty-free right to use such feedback without restriction or compensation.

Section 19. AI Outputs and Generated Content

19.1 Nature of AI Outputs

Generated Content is produced using automated technologies and artificial intelligence systems. Outputs may vary significantly between users and over time.

19.2 User Rights in Generated Content

Subject to these Terms and applicable law, KlosetAI grants users a non-exclusive right to access, use, download, and share Generated Content created through their own account.

19.3 Restrictions

Users may not falsely claim that Generated Content depicts real events where it does not, use Generated Content for unlawful activities, use Generated Content to impersonate others, or use Generated Content to violate privacy, publicity, or intellectual property rights.

Section 20. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. KLOSETAI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, PERFORMANCE, AND SECURITY.

Outfit suggestions, style recommendations, wardrobe recommendations, and fashion guidance are provided for informational, entertainment, and convenience purposes only. Users remain solely responsible for fashion, purchasing, sizing, styling, and wardrobe decisions. Virtual Try-On outputs are simulations and do not guarantee accurate representation of fit, appearance, sizing, comfort, or real-world results.

Section 21. Limitation of Liability

21.1 Exclusion of Certain Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLOSETAI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF DATA, OR REPUTATIONAL HARM.

21.2 Liability Cap

To the maximum extent permitted by law, KlosetAI's aggregate liability arising out of or relating to the Service shall not exceed the greater of: (a) the amount paid by the user to KlosetAI during the twelve (12) months preceding the claim; or (b) INR 10,000. Certain jurisdictions may not permit portions of this limitation. In such jurisdictions, liability shall be limited to the maximum extent permitted by law.

Section 22. Indemnification

You agree to defend, indemnify, and hold harmless KlosetAI and its affiliates, officers, directors, employees, contractors, licensors, partners, successors, and agents from and against any claims, damages, liabilities, losses, judgments, settlements, costs, expenses, and legal fees arising from your use of the Service, your User Content, your violation of these Terms, your violation of applicable law, your infringement of intellectual property rights, disputes between you and third parties, or misuse of Generated Content.

Section 23. Privacy

Your use of the Service is also governed by the KlosetAI Privacy Policy. The Privacy Policy explains how personal information, images, Body Profile Images, Generated Content, account data, and related information are collected, processed, stored, transferred, and protected.

Section 24. International Users and European Users

The Service may be accessed from jurisdictions outside India. Users are responsible for complying with local laws applicable to their use of the Service. Where applicable, KlosetAI intends to process personal data in accordance with applicable European data protection requirements. Users acknowledge that information may be processed, stored, or transferred across multiple jurisdictions where KlosetAI, its service providers, or infrastructure providers operate.

Section 25. Changes to the Terms

KlosetAI may update these Terms from time to time. Updated versions become effective upon publication unless otherwise specified. Continued use of the Service following changes constitutes acceptance of the revised Terms.

Section 26. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Section 27. Dispute Resolution

Before initiating formal legal proceedings, users agree to attempt good-faith resolution by contacting KlosetAI. Nothing in this section limits rights that cannot be waived under applicable law.

Sections 28–31. General Provisions

Severability: If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver: Failure by KlosetAI to enforce any provision of these Terms shall not constitute a waiver of any right or provision.

Assignment: KlosetAI may assign or transfer these Terms, in whole or in part, without restriction. Users may not assign or transfer their rights or obligations without prior written consent.

Entire Agreement: These Terms, together with any policies incorporated by reference, constitute the entire agreement between the user and KlosetAI regarding the Service and supersede prior agreements relating to the Service.
